Letter of Compliance

How to Apply?

• Application requirements

  Submit your application to the Planning and Urban Design Contact Us form at the bottom of the page.

  Application must include:

  1. A completed application form 
  2. The applicable fee as outlined in the Rates & Fees Bylaw
  3. A Real Property Report (RPR) prepared by a registered Alberta Land Surveyor in PDF format

  Process Times

  Complete applications are typically reviewed within seven business days. Expedited service is available for an additional fee (see Rates & Fees Bylaw).

• What is considered in a compliance letter review

  The compliance letter review is based on the Real Property Report submitted with the application. The review considers whether:

  • buildings and structures on the property comply with the minimum location and setback requirements of the Town’s Land Use Bylaw;
  • there are any encroachments into Roads, Town Lands, Parks or easements; 
  • any relaxation to minimum setback requirements have previously been approved through a development permit;
  • any structures are deemed legally non-conforming subject to section 643 of the MGA. This applies to structures that were permitted or approved under previous Land Use Bylaw regulations; i.e. structure were legal at the time of their approval but no longer conform to the current Land Use Bylaw.
• What happens if my property does not comply?

  The applicant will receive a Letter of Non-Compliance, describing the non-compliances with the Land Use Bylaw and advising how compliance may be achieved. Typically, this includes:

  • Removal of encroachments; 
  • Application for a Development Permit to allow structures to remain as-and where-built in  accordance with the Town’s Land Use Bylaw; and/or
  • Application for an Encroachment Agreement where structures encroach into roads, Town lands or easements for municipal purpose. An Encroachment Agreement must be registered on the subject parcel’s Certificate of Title.
  • Where all non-compliances have been addressed, a new Real Property Report may be submitted to receive confirmation of compliance.
• Encroachments

  Encroachments of buildings or structures into Roads, Town Lands or Easements are managed through the Town’s Encroachment Policy (link). Where an encroachment has been identified, the Landowner must either remove the encroachment or apply to the Town for the authorization of the encroachment. An application for an Encroachment Agreement must be emailed to the Town at compliance@okotoks.ca and must include: 

  • A completed Encroachment Agreement application form
  • The fee set out in the Town’s Fees Rates and Charges Bylaw 
  • A copy of the Certificate of Title obtained not more than thirty (30) days prior to the application date
  • Copies of any Restrictive Covenants, Utility Rights of Way, Easements or Caveats on the title
  • Where the property will transfer to new ownership prior to registration of the Caveat for the Encroachment Agreement, the name of the new landowner(s) as it will appear on the title
  • A Real Property Report
  • Photos of the encroaching feature
